Was ist ein KN-Code und woher bekomme ich ihn?
Der KN-Code (Kombinierte Nomenklatur) ist der 8-stellige Zollcode einer Ware, derselbe, den Sie in der Zollanmeldung und auf der Ausfuhrrechnung verwenden. Sie finden ihn in Ihren Zollunterlagen, im TARIC-System oder bei Ihrer Zollagentur. In Restrikt geben Sie ihn ein, um den Sanktionsstatus der Position zu prüfen.
Was bedeutet es, wenn im Ergebnis kein KN-Code gefunden wird?
Kein Treffer bedeutet nur, dass der angegebene KN-Code in unserer Datenbank der Sanktionsregime nicht gefunden wurde, nicht, dass der Handel erlaubt ist. Prüfen Sie eine höhere Ebene des KN-Codes, das jeweils andere Sanktionsregime und separat die Listen sanktionierter Personen und Organisationen. Maßgeblich ist der Text der EU-Verordnung, nicht das Ergebnis des Werkzeugs.
Worin unterscheidet sich das Sanktionsregime 833/2014 (Russland) von 765/2006 (Belarus)?
Es handelt sich um zwei getrennte Rechtsakte der EU mit eigenen Warenanhängen. Die Verordnung 833/2014 betrifft Russland, die Verordnung 765/2006 Belarus. Derselbe KN-Code kann in einem Sanktionsregime verboten sein und im anderen fehlen. Deshalb prüfen Sie die Ware für jedes Bestimmungsland separat, und Restrikt zeigt das Ergebnis mit der Rechtsgrundlage des jeweiligen Sanktionsregimes.
Welche Sanktionsregime deckt das Werkzeug ab?
Vier EU-Warenregime: Russland (Verordnung 833/2014), Belarus (Verordnung 765/2006), Nordkorea (Verordnung 2017/1509) und Iran (Verordnung 267/2012). Bei jedem Ergebnis sehen Sie die Rechtsgrundlage, also Anhang und Artikel, sowie den Datenstand der konsolidierten Fassung mit Link zum vollständigen Text in EUR-Lex.
Was ist die No-Russia-Klausel (Art. 12g) und wen betrifft sie?
The No Russia clause is a requirement under art. 12g of Regulation 833/2014 to contractually prohibit the re-export of certain sensitive goods to Russia in sales to third countries. It applies to EU exporters selling, among others, dual-use goods and items from selected annexes. In practice you place the relevant contractual clause in the contract and on the invoice, and its absence may be treated as a failure of due diligence.
Was bedeutet eine Ausnahme oder Abweichung nach Art. 3k?
Article 3k of Regulation 833/2014 bans the export of a broad list of industrial goods set out in Annex XXIII. At the same time it provides exemptions and derogations, that is situations where trade remains permitted, for example performing contracts concluded before the ban took effect. Exemptions are attached to the article, not to the individual CN code, so Restrikt shows the mechanism of the article covering your code and points to the relevant paragraph on EUR-Lex. Whether it applies to a specific transaction is confirmed by the customs authority or a law firm.
Ist CBAM eine Sanktion?
Nein. CBAM, das CO2-Grenzausgleichssystem, ist eine Berichts- und Zahlungspflicht bei der Einfuhr CO2-intensiver Waren wie Stahl, Aluminium, Zement oder Düngemittel. Sanktionen sind Handelsverbote und -beschränkungen aus den Verordnungen 833/2014 und 765/2006. Es sind zwei verschiedene Rechtsregime, daher kann dieselbe Ware unter CBAM fallen und gleichzeitig nicht sanktioniert sein, oder umgekehrt.
Wie dokumentiere ich die Sorgfaltspflicht beim Export?
Halten Sie die Prüfung jeder Position fest: KN-Code, Sanktionsstatus, Sanktionsregime, Anhang und Artikel, Datenstand der Verordnung und EUR-Lex-Link. Ergänzen Sie die Prüfung des Geschäftspartners gegen Sanktionslisten und, wo Art. 12g es verlangt, die No-Russia-Klausel im Vertrag. Worin unterscheidet sich das vom Screening von Personen und Organisationen?
Restrikt prüft die Ware, also ob ein KN-Code einem Einfuhr- oder Ausfuhrverbot bzw. einer Beschränkung unterliegt. Das Sanktionsscreening ist ein separater Prozess, der den Geschäftspartner, also eine Person oder Organisation, gegen Sanktionslisten prüft. Beide Schritte sind nötig, das Werkzeug ersetzt das Screening des Geschäftspartners nicht.
Ist das eine Rechtsberatung?
