Terms of Service

§1Definitions
- Service: the Restrikt website available at sankcje.exportsy.pl, restrikt.eu, together with its programming interface (API).
- Service Provider: the entity named in §2 that operates the Service.
- User: a natural person, legal person or organisational unit using the Service.
- Consumer: a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code. The provisions on Consumers also apply to a natural person entering into a contract directly related to their business activity where the contract is not of a professional nature for that person.
- Account: a User account in the Service, signed in to with a one-time link sent to an email address.
- Check (screening): a single query for a CN code or product name submitted through the Service search.
- Result: the Service response to a Check, that is a match of the code to entries in the goods annexes of the covered EU regimes or no match, together with the legal basis, exemptions, data quality and source version date.
- Report: a document with the date and time of a Check, its scope and the source versions, intended for printing or saving as PDF.
- Free Plan, Pro Plan, Team/API Plan: the scopes of use of the Service described in §4, §6 and §7 and in the pricing.
- API: the Service programming interface described in the API documentation, including GET /api/v1/cn.
§2Service Provider and contact
- The Service Provider is Custom Service, ul. Bielska 107, 32-652 Bulowice, Poland, NIP (tax ID) 5492373228, REGON 528250567. Restrikt is a brand of the Service Provider.
- Contact with the Service Provider, including complaints and statements: kontakt@restrikt.eu.
- Using the Service requires a device with internet access and a current browser with JavaScript enabled. An email address is required for the Account, alerts and purchases.
§3What Restrikt is and what it is not
- Restrikt is a goods code screening tool that supports the User in making a decision. It shows whether a CN code appears in the goods annexes of the EU sanctions regimes covered by the Service. The list of regimes and the source version date are given with every Result.
- Restrikt is not a law firm or a customs agency and does not provide legal services. A Result and a Report are not legal or customs advice, a binding tariff information or a decision on whether a transaction is lawful.
- The consultation form is used to pass on an enquiry. The provider, scope and price of a consultation are agreed with the User individually before it starts. Submitting the form does not conclude a contract.
§4Free Plan
- The Free Plan includes 5 Checks in total, without renewal. The limit is counted by the server. Without signing in, the browser is recognised by the limit cookie (details in the Privacy Policy); once signed in, the limit is counted for the Account.
- Providing an email address, for example to receive a Result by email, does not increase the limit and is not a newsletter sign-up.
- In the Free Plan you can watch one CN code in the Account, or sign up without an Account for an alert on a code, confirmed by clicking the link in an email.
- In the Free Plan bulk checking covers up to 10 codes per run; the Pro Plan removes this limit.
- Information pages for codes, annexes and regimes are available without a limit.
§5Account
- An Account is created by entering an email address. Signing in is done with a one-time link sent to that address. Authentication is handled by the provider Supabase.
- An Account is also created automatically after a plan is paid for. The sign-in link is then sent to the address given at payment.
- Anyone with access to the mailbox assigned to the Account can sign in to it. The User is responsible for securing access to their mailbox and should report unauthorised access to us without delay.
- The Account contains: the history of Checks, saved automatically while signed in, which the User can delete at any time; watched codes and alerts; invoicing details; and subscription management.
- The User may delete the Account at any time themselves, with the „Delete Account” button in the Account, or on request sent to kontakt@restrikt.eu from the address assigned to the Account. Deleting the Account immediately cancels an active subscription, with no further charges; the paid period is not refunded automatically, which does not limit consumer rights, including the right of withdrawal. Unused pack credits assigned to the Account address are forfeited. Data we must keep by law (e.g. orders and invoices) is retained for the required period without the email address.
§6Pro Plan
- The Pro Plan includes the features working in the Service today: watching CN codes without a limit with an email when their status changes (checked once a day), unlimited Reports to print or save as PDF, checking many codes at once without the per-run code limit, with CSV export, the history of Checks in the Account and email support.
- Features marked in the pricing as „planned or by arrangement” are not part of the service until they are made available or agreed with the User.
§7Team/API Plan
- The Team/API Plan includes the scope of the Pro Plan plus individual arrangements, for example an API key with a higher request limit and change webhooks. Scope, price and terms are agreed before the contract is concluded, in writing or by email.
- Multi-user accounts, a shared archive, a team activity log (audit log) and an SLA are not currently available in the Service. They may be the subject of a separate agreement.
§8Payments and subscription
- Payments are handled by Stripe (Stripe Checkout). You enter card details on the Stripe page; they do not reach the Service Provider.
- The Pro Plan is a monthly subscription paid in advance. It renews automatically for further months until you cancel it.
- We activate the plan once Stripe confirms the payment, usually within a few minutes. For some payment methods the confirmation may arrive later.
- You can cancel the subscription at any time in the Stripe billing portal available from the Account („Manage subscription”) or by writing to kontakt@restrikt.eu. After cancellation the subscription does not renew. The Stripe portal shows the plan end date before you confirm the cancellation; after that date the Account returns to the Free Plan. History and watched codes remain in the Account.
- Prices in the pricing are net prices. VAT is added according to the buyer's country and status, and the final amount due is shown in the Stripe checkout before payment. Tax is calculated by Stripe according to the buyer's country and status; EU businesses with a valid VAT number are subject to the reverse-charge mechanism.
- An invoice is issued for every payment and delivered electronically. To receive a business invoice, enter your VAT number in the checkout before paying.
- One-off purchase: a single Report or a pack of 10 Reports, without creating an Account. A Report is delivered after payment confirmation to the address given in the checkout; the link works for 12 months. A pack is recorded as credits on the payment address, valid for 12 months; a Report paid with a credit is sent only to that address. Unused credits expire.
- We do not issue a Report if the data for the code is not verified or the code does not exist in the Combined Nomenclature. In that case no payment is taken.
§9Consumer rights
- A Consumer may withdraw from a distance contract within 14 days without giving a reason, subject to paragraph 2.
- A Report and pack credits are digital content supplied immediately. The right of withdrawal does not apply if supply began with the Consumer's express consent before the withdrawal period ended, after the Consumer was informed of losing that right, and the Consumer received a confirmation (Article 38(1)(13) of the Polish Consumer Rights Act). The consent and acknowledgement are collected in the Stripe checkout.
- The Pro Plan subscription is a digital service. A Consumer may withdraw from it within 14 days of concluding the contract. Settlement after withdrawal follows the Polish Consumer Rights Act.
- A withdrawal statement can be sent to kontakt@restrikt.eu. The model form in Annex 2 to the Polish Consumer Rights Act may be used but is not required.
- If the digital content or digital service does not conform to the contract, the Consumer has the rights under Chapter 5b of the Polish Consumer Rights Act.
- These Terms do not exclude or limit the Consumer's rights under mandatory provisions of law.
§10API
- API requests without a key have a daily limit per IP address stated in the API documentation. Exceeding the limit returns status 429.
- API keys are issued individually. A key must not be shared with third parties; the User is responsible for requests sent with their key.
- It is prohibited to: circumvent limits and security measures (e.g. rotating IP addresses or creating several accounts to increase the limit), retrieve data automatically (scraping, bulk extraction) outside the API and its limits, and resell or share access to the Service, the API or the data without the Service Provider's consent.
- In the event of a breach of these rules, the Service Provider may restrict access or revoke the key after prior notice, unless the breach threatens the security of the Service.
- We do not guarantee uninterrupted availability of the Service or the API. Changes that break compatibility of API v1 responses are introduced as a new API version.
§11Data entered by the User
- A CN code or product name is enough for a Check. Do not enter personal data, counterparty names, contract numbers or confidential information in the search or in forms unless they are needed for the answer.
- While signed in, queries are saved in the Account history. The history can be deleted in the Account.
- The rules for processing data are described in the Privacy Policy.
§12Nature of the Result and the Report
- A Result is informational. The decision on a transaction is taken by the User.
- A no-match result does not mean that trade in the goods is permitted.
- A goods code check does not replace: screening the counterparty against sanctioned persons and entities lists, verifying the destination and end use, correct tariff classification (choice of the CN code), dual-use goods controls, or checking other regimes and restrictions, including national ones.
- Primary sources take precedence: the text of legal acts on EUR-Lex, for tariff measures the TARIC database, and in individual cases the decision of the competent authority, including customs authorities.
- A Report documents that a specific Check was performed according to the data and source versions indicated in the Report. A Report is not evidence that a transaction was lawful. The scope of the Check and what it does not cover are listed in the Report's SCOPE block.
- Every Result shows data quality. An entry marked as requiring verification should be confirmed in the source. How the data is prepared is described in the methodology.
- The Service Provider exercises due care in updating the data. It is liable under general rules, and towards Consumers to the extent provided by mandatory provisions of law.
§13Intellectual property
- The rights to the Service, its code, design, texts, the name „Restrikt” and the database to the extent prepared by the Service Provider (structure, code normalisation, descriptions) belong to the Service Provider. The text of EU legal acts is not covered by these rights.
- The User may use Results and Reports for their own business, including storing, printing and passing them to counterparties, advisers and authorities.
- Without the Service Provider's consent, the database may not be copied in whole or in substantial part, published or resold.
§14Complaints
- Complaints and remarks about the Service are accepted at kontakt@restrikt.eu. Describe what the report concerns and give the Account or order email address.
- We respond within 14 days, electronically.
- A Consumer may use out-of-court dispute resolution, including help from a municipal or district consumer ombudsman and the voivodeship Trade Inspection.
§15Changes to the Terms
- We may amend the Terms for important reasons: changes in the law, changes in the scope or manner of providing the services, security reasons or a change of the Service Provider's details.
- We announce changes on the website and, to Users with an Account and an active subscription, also by email, before the change takes effect. Anyone who does not accept the change may cancel the subscription before that date.
- The current version is available at restrikt.eu/en/regulamin.
§16Governing law
- Matters not regulated herein are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
- The choice of Polish law does not deprive a Consumer of the protection afforded by the mandatory provisions of the country of their habitual residence.
